"Make a Cool Change: Recycle Your Old Fridge" Sweepstakes

TIMING: The "Make a Cool Change: Recycle Your Old Fridge Sweepstakes" (the "Sweepstakes") begins on April 1, 2009, at 12:01AM Eastern Time (ET) and ends on April 30, 2009 at 11:59 PM ET.
ELIGIBILITY REQUIREMENTS: Sweepstakes open to all legal residents of the fifty (50) United States (including the District of Columbia) or Canada (excluding Quebec), who are eighteen (18) years of age or older at time of entry. Employees of Whole Foods Market (the "Sponsor"), Bosch Home Appliances, and all affiliates, divisions, or subsidiaries of each, as well as vendors/agencies and the immediate family/household members of these entities, are not eligible to enter. Sponsor reserves the right to verify the eligibility of any entrant or winner.
HOW TO ENTER: Visit the "Make a Cool Change: Recycle Your Old Fridge Sweepstakes" website at www.wholefoodsmarket.com/earthmonth. Enter your information using the online entry form and submit. Each entrant is limited to one registration during the Promotion Period. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries become the property of the Sponsor and will not be returned. Automated/robotic entries are prohibited, and any use of such entry devices will cause disqualification. Sponsor and its advertising and promotion agencies are not responsible for lost, late, incomplete, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic.
PRIZES: There are eleven (11) Grand Prizes of a Bosch "Evolution" Refrigerator, having an Approximate Retail Value ("ARV") of $2250. Grand Prize winners will also receive $150 in Whole Foods Market products to fill their refrigerator and pantry (which may be awarded in the form of gift cards, at the Sponsor's sole discretion). The Bosch Refrigerator will include delivery to the winners' homes, installation (excluding plumbing/carpentry), and removal of the old refrigerator, if desired. Each Grand Prize has an ARV of $2400. Total ARV of all prizes to be awarded is $26,400.
DRAWING AND NOTIFICATION: Grand Prize winners will be determined in a random drawing from among all eligible entries received, which will be held on or about May 8, 2009, by The US Sweepstakes & Fulfillment Co., an Independent Sweepstakes Administrator whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend on the number of eligible entries received. Winners will be notified by phone, email or mail. If a potential winner cannot be reached within five (5) calendar days from the first notification attempt, then such person shall be disqualified and an alternate winner will be selected. Winners will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days of date on written notification, or prize will be forfeited and awarded to an alternate winner. If a Canadian resident is selected as a winner he/she will be required to complete an unaided mathematical skill question before being declared an official winner.
PRIZE CONDITIONS: The Bosch refrigerator will be delivered to the winner's home and installed in the appropriate place in the kitchen provided that the refrigerator fits in the current space. Installation will not include any plumbing work required to install water/ice-making hook-ups. Sponsor will not be responsible for any carpentry work if the appropriate space is not able to accommodate the prize refrigerator. Winner must schedule the delivery and installation of the prize refrigerator prior to July 31, 2009, or the prize will be forfeited. Food/pantry products will be delivered separately. Sponsor reserves the right to make equivalent prize substitutions at its sole discretion. Winners are solely responsible for any and all incidental expenses and other fees and expenses not specified as associated with prize receipt and use. Sponsor will not replace any lost or stolen prizes. Prize warranties/guarantees are limited to prize provider's/manufacturer's standard terms and conditions. No substitution or transfer of prize is permitted, and no cash equivalent for any prize is offered, except at the sole discretion of the Sponsor. Sweepstakes is subject to all applicable federal, state, provincial and local laws. All taxes on prize offered, if applicable, are the sole responsibility of the winner. Grand Prize winners will receive an IRS Form 1099 in January of 2010, for the ARV stated above.
LIMITATION AGAINST LIABILITY: Winners agree that (except where prohibited) Sponsor may use their name, picture, portrait, likeness and voice for advertising and promotional purposes without further compensation. Sponsor, it's promotional and advertising agencies, and all respective officers directors, employees, representatives and agents shall have no liability and shall be held harmless by winner for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize, or participation in this Sweepstakes. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney's fees. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes should virus, bugs, non-authorized human intervention or other causes beyond the control of sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. In such event, Sponsor may award the prize in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated/robotic/quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor's representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
